We are required to obtain State and Federal environmental approval for the Albany Ring Road Stage 2 and 3b portion of the project, which has involved:
- March 2020: Referred the Albany Ring Road Stages 2 and 3b component to the Environmental Protection Authority (EPA)) for assessment under Part IV of the Environmental Protection Act (1986). The EPA determined that the proposal not to be assessed under Part IV of the EP Act. No advice given. January 2021 Application for a Clearing Permit was submitted to the Department of Water and Environmental Regulation (DWER) under Part V of the Environmental Protection Act (1986).
- September 2020: The same component of the project was referred to the Commonwealth for assessment under the Environment Protection and Biodiversity Act 1999 (EPBC Act).
The proposed action has been determined to be a controlled action under the EPBC Act and will be assessed through Preliminary Documentation. The controlling provision under Part 3 of the EPBC Act is listed threatened species and communities (section 18 and 18A).
In accordance with Section 95A(3) of the EPBC Act, Preliminary Documentation related to the proposed action is available for viewing again for a minimum of 10 business days from date of advertisement (26 October 2021). This is for information purposes only, as the final date for providing comment has passed.

The Dampier Highway Duplication project was referred by Main Roads to the Commonwealth Department of Sustainability, Environment, Water, Population and Communities (SEWPaC, now the Department of Environment and Energy - DotEE) under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) in 2010, as the Project impacted listed threatened species and communities as well as part of the project area occurring within a National Heritage Place. SEWPaC confirmed that the Project was a controlled action under the Act. Approval under the EPBC Act was obtained in July 2011 with conditions (EPBC 2010/5419). Condition 3 of EPBC 2010/5419 requires the publication of an annual compliance report on Main Roads’ website, addressing compliance with each of the conditions of EPBC 2010/5419.

Mitchell Freeway Extension (Burns Beach Road to Hester Avenue) was referred to the Department of the Environment and Energy (DotEE) for assessment under the Environment Protection and Biodiversity Conservation Act 1999 as the Project was deemed to potentially impact significantly on the listed threatened species, Carnaby’s Black Cockatoo (Calyptorhynchus latirostris). The Project was determined by the DotEE to be a ‘Controlled Action’ and was assessed through Preliminary Documentation. The DotEE issued approval of the Project on 2 September 2014 (EPBC 2013/7091) and included a number of conditions that we are required to fulfil.
Condition 7 of EPBC 2013/7091 requires the publication of an annual compliance report on Main Roads’ website, addressing compliance with each of the conditions of EPBC 2013/7091 over the previous 12 months. This report addresses compliance for the period 27 May 2018 to 27 May 2020.

Main Roads Western Australia referred the Mitchell Freeway Principal Shared Path Gaps Project Ocean Reef Road to Hepburn Avenue (the Project) to the then Department of Agriculture, Water and Environment (DAWE), now the Department of Climate Change, Energy the Environment and Water (the Department), for assessment under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) as the Project was considered to impact matters of national environmental significance (MNES) that include Tuart Woodlands of the Swan Coastal Plain Threatened Ecological Community (TWSCP TEC), Carnaby’s Cockatoo (Calyptorhynchus latirostris) habitat and Forest Red-tailed Black Cockatoo (FRTBC, Calyptorhynchus banksii naso) habitat.
Condition 5 of EPBC approval 202/8833 requires that all data, enquires and findings of the monitoring and investigation required by condition 3 must be published on the proponents website to contribute to potential research into the use of artificial nesting hollows by Black Cockatoo.
Condition 11 of EPBC approval 2020/8833 requires the publication of an annual compliance report on Main Roads’ website, addressing compliance with each approval condition of EPBC 2020/8833 over the previous 12 months.
The Murdoch Drive Connection project was delivered within the environmental footprint of the former Roe 8 project. As a result, the same stringent State and Commonwealth Environmental Approvals granted for Roe 8 are applicable to the Murdoch Drive Connection. To meet the conditions of these approvals, we have developed a series of Environmental Management Plans, which have been endorsed by the Office of the Environmental Protection Authority.
