The Bunbury Outer Ring Road (BORR) recently ran a seminar for Aboriginal owned businesses on Contract and Commerce Basics. Attendees were given the opportunity to build their knowledge and skills in contract negotiation and commercial management.

On a project that is the scale and scope of BORR, there has been no shortage of contracts and commercial activity, especially with local South West and Aboriginal businesses. To help give back to the industry by drawing on the wider team’s experience and expertise, a business seminar was recently held at the Dolphin Discovery Centre in Bunbury.

The Contract and Commercial Basics seminar took place on Tuesday 13 February with 13 individuals from various businesses in attendance. This included nine Aboriginal owned businesses—eight of which are locally based, as well as Adrian Matthew (Alliance Director), Matt Prendergast (Commercial & Project Support Manager), and Ryan Taylor (Contacts Manager) from the BORR team.

The seminar was designed to help participants understand some of the fundamental contracting principles and gain confidence in discussing contract terms. The two presenters from Pinsent Masons—professional and legal service providers—offered practical examples and several ‘Golden Rules’ which businesses could take away from the session to protect their businesses when subcontracting.

The first part of the seminar dealt with the challenges facing small businesses in Western Australia. From the lack of resources to how to manage a contract effectively. Attendees were given the opportunity to understand the process, risks, and best practice approach to tendering for a contract.

Next came a breakdown of construction contracts formation, including the necessary components to ensure both parties agree and are set up for success. Participants were taken through the important clauses often present in a contract. These can range from payment terms and dispute process to scope of work, indemnities, and the procedure for extending timelines.

Last but not least, participants learned about the most recent legislative contractual updates when it comes to standard terms in the industry.

Attendees walked away with practical knowledge on negotiation, contract management, and legal updates to help improve their capabilities for commercial success.
